"I have been stopped for DUI!
What should I do???"
The first and best advise that you could have been
given would to have not driven if you believed that you may
be intoxicated. Unfortunately, we are well past that now.
The following is not intended as advice for someone that is intending to
attempt to "skirt" the law. They are however, important things for
you to know should you find yourself in this position.
Tulsa criminal attorney, John Dunn, has some
important advice regarding a DUI charge:

Do not take the
field sobriety exam. There is NO
requirement that you take a field sobriety test. By
cooperating in the test, you have given the officer evidence of your
balance, coordination, and physical appearance of intoxication.

Do not
testify against yourself. Typically, when a police
officer is dealing with someone he believes is intoxicated, he will
ask, "How much have you had to drink?" If you answer, that
statement CAN be used against you in court. The less you say,
the better off you are.

Do not "act
out." Alcohol often has the affect of lowering one's
inhibitions. People who have been drinking will sometimes say
things or act in ways that they would never act otherwise.
When you are in the presence of the police, you should ALWAYS
conduct yourself as though a camera crew were watching your behavior
with the intention of showing the video in court. Most patrol
cars are equipped with a "dash camera" and the things you do and say
on a traffic stop could come back to haunt you in court.

The Intoxilyzer
Test If you are arrested, the officer will ask you to
take "the state's test". If you have a BAC greater than the
legal limit, that evidence can be used in court to prove your guilt.
On the other hand, if you refuse the state's test, you will have
denied the state access to evidence of your BAC, but you will have
made the retention of your driver's license more difficult.
